How do I convince a Debt Collecting Agency that I do not owe the money they are demanding?


I cancelled my phone agreement with Talk Talk but after disconnection they continued to send me bills. After repeated phone calls they have agreed that I do not owe them any money and have sent me a cheque for £9. which they in fact owed me. However they have passed on the debt to a Debt Collecting Agency who have written to me threatening to send in the Bailiffs. I have phoned them and they say it is my responsibility to ensure that Talk Talk cancel the outstanding "debt" directly with them and they are sending in Bailiffs to take goods to the value of £40 plus s and if I do not pay they will charge me an extra £100. administration costs. Surely they can't do this?

This is a surprisingly common query.

To be fair the debt collection company are only acting on the instruction of the original creditor.

You should get some written confirmation from TalkTalk that your account has been settled.

If the debt collection company contacts you after that they may be breaking the law (s.40 - Administration of Justice Act1970)
