Can a Baliff enter my new home to cover a debt? |
Hi there,
A couple of years ago I got in some debt and was unable to pay two speeding tickets. I moved house several times, however the Baliff contacted me just prior to moving from my previous address. The letter stated that they could use a locksmith to enter my old address to take belongings.
Since then, things have picked up for me and I have moved house. Wanting to pay the debt, I contacted the Baliff and was upfront with my contact details and even my new address. I was expecting to have the full £405 to clear the debt this week, however I have not been paid and the Baliff is contacting me daily. I have told him that as soon as I have the money I will contact him to arrange to pay.
My concern is, can he lawfully use a locksmith to enter my new address, despite the original letter referring to my previous address, or do they have to go back to court to get a new warrant for this new address. Can they lawfully use a locksmith generally? That is what was stated.

Not many people would have been as honest as you. Well done for that.
For a fine a bailiff can certainly use a locksmith to enter a property. It isn't normal practice however and given the fact you have offered to pay it would be pretty unreasonable and pointless for them to do this (they would add the costs to your bill).
Bailiffs don't usually want to enter properties, they want the money. Make every effort to get them the cash as soon as possible.
If the bailiff is in any way unprofessional you MUST complain to their company and to their regulatory body.
