Can a bailif take stuff from my mums?? |
I use my mums address for post and I have a warrent against me that I cant appeal against till monday, And the bailiff said he is coming monday, But I do not live there and I dont have any property there, So does he have any rights to enter that property, My mum is on the tenancy and pays the bills, The warrent is against me not the address, My mum has just come out of hospital and needs care so I go round to get post and see how she is every now and then to take over from her friends daughter that looks after her, Any help would be appreciated.
Thanks, John
Re: Can a bailif take stuff from my mums??
The bailiff will go to the property and charge you for the visit. If you aren't there he or she will then make efforts to find out where you live.
If your mother tells the bailiff you don't live there and that she is ill he or she should leave.
He or she is acting on behalf of the court so until you contact the court they will do their best to collect the sum owed - and of course will continue to add charges to the debt. You can speak to the court if you feel these charges are unfair.
As you will read on this site and others such as www.consumeractiongroup.org the bailiff profession has some pretty persistent people working within it. You need to address this situation as quickly as possible for your mother's sake as well as your own.
If the bailiff acts in any way unprofessionally you can complain to their company, the court and to his or her regulatory body. The details of these are elsewhere on this site or via this link to the Department of Constitutional Affairs.
